By accessing or using the Service, You agree to be bound by these Terms. If You do not agree, You may not use the Service.

Interpretation and Definitions

Interpretation

Words with capitalized initial letters have meanings defined under the following conditions. These definitions apply whether the terms appear in singular or plural form.

Definitions

For the purposes of these Terms of Service:

  • Account
    A unique account created for You to access the Service.
  • Application
    MenuMiru, the software application provided by the Company.
  • Company

    (referred to as "the Company", "We", "Us", or "Our").
  • Content
    Text, images, photos, or other material posted, uploaded, or otherwise made available through the Service.

    Japan
  • Device
    Any device that can access the Service, such as a computer, mobile phone, or tablet.
  • Service
    The Application.
  • Subscription
    A recurring payment plan that grants access to premium features of the Service.
  • Free Tier
    The basic level of the Service available at no cost.
  • You
    The individual or legal entity accessing or using the Service.

Accounts

Account Creation

To use certain features, You must create an Account. You agree to provide accurate and complete information and to keep it up to date.

Account Security

You are responsible for maintaining the confidentiality of Your Account credentials. You agree to notify Us immediately of any unauthorized use.

Account Termination

We reserve the right to suspend or terminate Your Account at any time if You violate these Terms or engage in prohibited activities.

You may delete Your Account at any time through the application settings.

Subscriptions and Payments

Free Tier

The Service offers a free tier with limited functionality. No payment is required.

The Service may offer paid Subscription plans that provide access to premium features. By purchasing a Subscription, You agree to the following:

  • Billing: You will be charged in advance on a recurring basis (monthly or annually) depending on the plan selected.
  • Payment Provider: Payments are processed through Stripe. By subscribing, You also agree to Stripe's terms of service.
  • Automatic Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.
  • Price Changes: We may change Subscription prices at any time. Price changes take effect at the start of the next billing period after notice is provided.
  • Cancellation: You may cancel Your Subscription at any time through Your account settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods.

Refunds

Refund requests are handled on a case-by-case basis. To request a refund, contact Us at the email provided below. Refunds may be issued at Our sole discretion.

Failed Payments

If a payment fails, We may suspend access to premium features until the payment is resolved.

User Content

Your Content

You retain ownership of Content that You upload or submit through the Service. By posting Content, You grant Us a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute Your Content solely for the purpose of operating and improving the Service.

Content Responsibility

You are solely responsible for Content You post. You represent that You have all necessary rights to the Content and that it does not violate any third-party rights.

Prohibited Content

You agree not to upload Content that:

  • Is unlawful, harmful, threatening, abusive, or harassing
  • Infringes on intellectual property rights of others
  • Contains malware or harmful code
  • Is spam or unsolicited advertising
  • Impersonates another person or entity

Content Removal

We reserve the right to remove any Content at Our sole discretion, without prior notice, for any reason including Content that violates these Terms.

Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service
  • Scrape, crawl, or use automated means to access the Service without permission
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service to transmit harmful or malicious content
  • Violate the rights of other users

Intellectual Property

The Service and its original content (excluding User Content) are and remain the property of the Company. The Service is protected by copyright, trademark, and other laws. Our trademarks may not be used without prior written consent.

AI-Generated Content

The Service uses artificial intelligence to process and translate menu content. AI-generated results are provided on an "as is" basis and may contain inaccuracies. We do not guarantee the accuracy, completeness, or reliability of AI-generated translations or recommendations.

Third-Party Services

The Service may contain links to or integrate with third-party services, including but not limited to Google Places. We are not responsible for the content or practices of third-party services. Your use of third-party services is governed by their respective terms and policies.

Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from Your use of the Service.

In no event shall the Company's total liability exceed the amount paid by You to the Company during the twelve (12) months preceding the claim, or one hundred US dollars (USD 100), whichever is greater.

Disclaimer

The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Japan, without regard to conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved informally. If not resolved within thirty (30) days, disputes shall be submitted to the exclusive jurisdiction of the courts located in Tokyo, Japan.

Changes to These Terms

We may update these Terms at any time. Changes are effective upon posting. The "Last updated" date will be revised accordingly. Continued use of the Service after changes constitutes acceptance of the revised Terms.

For material changes, We will provide reasonable notice before the new terms take effect.
